~ Mission Statement ~

     Martin Schroeder will provide the highest level of service to all his clients and customers.

     A Client is defined as someone who has established a relationship with Martin Schroeder to represent them in a Real Estate transaction as in an Exclusive Right to Sell Listing Agreement, a Real Estate at Auction Agreement, or as a Buyer of Real Property listed with another Real Estate Brokerage Firm.

     A Customer is defined as someone with whom Martin Schroeder is working with to show and/or sell an in-house listed property.
     I hope you will find this information to be helpful to you as you begin your real estate transaction.  When you are ready to enter into a transaction, you will be presented an Agency Disclosure Form as a legal requirement from the State of Ohio, which specifically indentifies the role of the agents and brokerages.  Please ask questions if there is anything you do not understand.

     Because it is important that you have this information, Ohio law requires that we ask you to sign a panphlet when asked, acknowledging receipt of this Consumer Guide.  Doing so will not obligate you to work with our company if you do not choose to do so.

~ Representation ~

Representing the Seller:      

     When sellers of real estate choose to list their property for sale they will sign a Listing Agreement or a Real Estate at Auction Agreement that authorizes the Brokerage Firm to represent their interests. This is referred to as Seller’s Agency. When Martin Schroeder is a seller's agent, he will follow the seller's lawful instructions, be loyal to the seller, promote the seller's best interests, disclose material facts to the seller, maintain confidential information, act with reasonable skill and care and, account for any money he handles in the transaction. 

Representing the Buyer:     

     When purchasing real estate, buyers may choose to work with a real estate agent as well. Often the buyers want to be represented in the transaction. This is referred to as Buyer's Agency. When Martin Schroeder is a buyer's agent in a transaction he will follow the buyer's lawful instructions, be loyal to the buyer, promote the buyer's best interests, disclose material facts to the buyer, maintain confidential information and, account for any money he handles in the transaction.

 Dual Agency:     

     Occasionally the same agent and brokerage that represents the seller also represents the buyer. This is referred to as Dual Agency. When a brokerage and its agents become "dual agents," they must maintain a neutral position between the buyer and the seller. They may not advocate the position of one client over the best interests of the other client, or disclose any personal or confidential information to the other party without written consent.  
     Martin Schroeder as a broker and/or agent will never act as a Duel Agent except as noted here.

~ Exceptions ~  

     In the event that someone with whom Martin Schroeder has a personal, family or business relationship is seriously interested in any in-house listing, Martin Schroeder will inform the Seller of this relationship and of that party’s interest in Seller’s property. The Seller will be given the opportunity to withdraw the listing and have another Brokerage firm represent them if they so desire or they may represent themselves.  The Seller may, if they so desire, may wish to keep the listing in-house with Martin Schroeder.  In this case, Martin Schroeder will act as a Disclosed Duel Agent as provided and permitted by The Ohio Revised Code.
     Martin Schroeder will treat all parties honestly and fairly.  He will not be biased to either party and will remain in a neutral position. He will prepare and present Offer to Purchases and Counteroffers at the direction of the parties as prescribed by law. 
     At no time will Martin Schroeder disclose personal or confidential information to the Buyer or Seller about the other party that would compromise any negotiations.
     In the event that the Real Estate is being offered at Public Auction, Martin Schroeder will only represent the seller.

MY OFFICE POLICY

 Working with this Brokerage Firm: 
     Martin Schroeder will only represent sellers and he does not represent buyers of real estate on properties that are for sale as in-house listings. Therefore, Martin Schroeder will never act as a dual agent representing both parties in a transaction except as noted within this pamphlet. 
     He will only act as the seller's agent in the sale of real estate for all in-house listings. Even though Martin Schroeder lists properties for sellers, he can still work with buyers as customers. He can provide such buyers with non-confidential information and write offers at the buyer's direction, but will not act as the agent of these buyers. Instead, such buyers will represent their own best interests. It is also important for buyers to understand this because Martin Schroeder has a duty of full disclosure to the seller and the buyers should not share any information that they would not want the seller to know.

Working with other Brokerage Firms: 
     Martin Schroeder does cooperate with and offers compensation to other brokerages on properties that are listed for sale on in-house listings. Those other brokerages will always represent the buyer and they will never be a sub-agent of the Broker or represent the Seller.  Martin Schroeder also accepts compensation offered from other Brokerage Firms on properties that they have listed for sale.  Martin Schroeder will be acting as a buyer's agent in these situations. 
     You should understand that just because there is a fee splitting arrangement between Martin Schroeder and other Brokerage Firms, your representation in a Real Estate transaction is not determined by who pays the brokerage fee.

Fair Housing Statement: 
     It is illegal, pursuant to the Ohio Fair Housing Law, division (H) of Section 4112.02 of the Revised Code and the Federal Fair Housing Law, 42 U.S.C.A. 3601, to refuse to sell, transfer, assign, rent, lease, sublease or finance housing accommodations, refuse to negotiate for the sale or rental of housing accommodations, or otherwise deny or make unavailable housing accommodations because of race, color, religion, sex, familial status as defined in Section 4112.01 of the Revised Code, ancestry, military status as defined in that section, disability as defined in that section, or national origin or to so discriminate in advertising the sale or rental of housing, in the financing of housing, or in the provision of real estate brokerage services. It is also illegal, for profit, to induce or attempt to induce a person to sell or rent a dwelling by representations regarding the entry into the neighborhood of a person or persons belonging to one of the protected classes.                


The Real Estate Recovery Fund:

     This Fund was created as a source of revenue for unsatisfied civil judgments against a person holding a real estate license. (Ohio Revised Code 4735.12)
